These terms govern your use of francesmendez.com and the materials available through it, including the Build Your Second Brain guide.

The guide and tools on this site are free to use in your own work, including commercially. They are not free to resell, republish, or distribute as your own. Everything is provided without warranty, it is general information rather than professional advice, and my liability is limited to the extent the law allows.
These Terms of Use govern your access to and use of francesmendez.com and the materials made available through it, including the Build Your Second Brain guide (together, the “Site”). The Site is operated by Frances Méndez, an individual based in Los Angeles, California (“I,” “me,” or “my”).
By accessing the Site, downloading the guide, or submitting your email address, you agree to these terms. If you do not agree to them, do not use the Site.
These terms govern the Site only. They do not govern any engagement with Camino5, which contracts separately and on its own terms.
Subject to these terms, I grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access the Site and to use the guide and other materials for your own purposes, including within your own business.
You may: read, download, and print the materials for your own use; apply the methods and prompts they describe to your own work; and share a link to this Site.
You may not: sell, license, or otherwise commercialise the materials; republish or redistribute them, in whole or in substantial part, in any medium; host the guide file for download elsewhere; incorporate them into a paid course, membership, or client deliverable presented as your own work; remove or alter any attribution or copyright notice; or use them to train a machine learning model without my prior written permission.

All content on the Site, including the guide, written articles, tools, layout, and design, is my property or is used with permission, and is protected by copyright and other intellectual property laws. Photographs are credited to Sheena Lad, Váve Photo, and remain the property of their creator. Nothing in these terms transfers ownership of any intellectual property to you.
THE SITE, THE GUIDE, AND ALL MATERIALS AND TOOLS MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, I make no warranty that the materials are accurate, complete, or current; that the third-party software they describe will continue to function as described; that the Site or any tool will be uninterrupted or error-free; or that any particular result will follow from their use. The artificial intelligence products referenced in the guide are developed and operated by third parties, change frequently, and are outside my control.
The Site provides general information based on my own working practices. It does not constitute legal, financial, tax, accounting, medical, or other professional advice, and no professional or advisory relationship is created by your use of the Site, your download of the guide, or your correspondence with me. Outcomes depend on circumstances specific to you. Consult a qualified professional before acting on any matter requiring professional judgement.
To the fullest extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of or inability to use the Site, the guide, or any tool, whether based in contract, tort, strict liability, or any other theory, and whether or not I have been advised of the possibility of such damages.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful injury, violation of law, or any other liability that may not lawfully be excluded or limited, including under California Civil Code section 1668. If any limitation in this section is held unenforceable, it shall not apply, and the remainder of these terms shall continue in effect.
The Site links to websites and services I do not operate. I am not responsible for their content, availability, or privacy practices, and inclusion of a link does not imply endorsement.
This includes the two tools referenced on the guides page. tools.francesmendez.com is operated by me and is subject to these terms and to my Privacy Policy. tools.camino5.com is operated by Camino5, a separate company, and is subject to its own terms and privacy notice. Review those before using it.
By submitting your email address, you consent to receive email from me, including the material you requested and periodic newsletters. Every message contains an unsubscribe link, and you may withdraw consent at any time by using it. Handling of your address is described in the Privacy Policy.
I may modify, suspend, or discontinue the Site, the guide, or any tool, in whole or in part, at any time and without notice. I may also revise these terms. Material revisions will be reflected in the effective date above. Your continued use of the Site after a revision constitutes acceptance of the revised terms.
These terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these terms or the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
If any provision of these terms is held invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force. My failure to enforce any provision is not a waiver of it. These terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding the Site.
